| dc.description.abstract | O artigo analisa criticamente como o racismo estrutural, originado no período escravocrata, permanece influenciando as relações sociais, institucionais e simbólicas no Brasil contemporâneo. De igual maneira, aponta que o Direito, embora historicamente tenha contribuído para a manutenção de desigualdades, passou a desempenhar papel fundamental na promoção da igualdade racial, sobretudo após a Constituição de 1988 e a criação de legislações específicas. | dc.description.abstract2 | This article critically analyzes how structural racism, originating from the slave era, continues to influence social, institutional, and symbolic relations in contemporary Brazil. It points out that the Law, although historically contributing to the maintenance of inequalities, has played a fundamental role in promoting racial equality, especially after the 1988 Constitution and the creation of specific legislation. However, the effectiveness of these norms is still limited due to the naturalization of racism and insufficient public policies. The research highlights the media as a central agent in reproducing racial stereotypes, influencing social perceptions, and reinforcing inequalities. In this context, it is argued that freedom of expression must be balanced with social responsibility, avoiding the propagation of discriminatory discourses. Furthermore, it emphasizes the need for critical legal education, capable of recognizing structural racism and acting towards its overcoming. Thus, it is important to consider that confronting racism requires integrated actions between Law, media, and society, promoting structural and cultural changes for a more just and egalitarian society. | |
